Tampa, FL : Prosecutors clear officer killed in vehicle crash on Friday October 2 2015


Prosecutors say a Florida officer who struck and killed a man who was lying drunk in the road will not face charges in the incident.Tampa Police Officer Jeremy Dabush, 26, did run over the man en route to a robbery in June, according to the review completed Friday by State Attorney Mark Uber, but was not aware of what happened.

It was something that was going to happen whether it was Dabush or some other person driving down the road," said the officer's attorney, Richard Escobar.A spokesman for the Tampa Police, Stephen Hegarty, said the department would proceed with its own internal affairs investigation of Dabush.

The report on the June 28 death of William Dale McIntire, 60, says the man was passed out in the street when Dabush, working undercover and driving a green SUV, hit him. The medical examiner's office said McIntire's blood alcohol level was 0.29, more than three times the level considered impaired for motorists. Escobar said the officer's tire ran over McIntire's head. Tissue from the victim's body was found on the undercarriage of Dabush's vehicle.
