NAPLES, FL : Jury deliberating in fatal Collier County crash on Tuesday, June 20, 2017
The jury has been dismissed for the evening. They'll restart deliberations Tuesday morning.Jurors are deliberating the fate of a Collier County man charged with DUI manslaughter.
Rene Miles, 42, is accused of drinking and driving, causing a crash that took the life of a Golden Gate father of four.
The case went to the jury just after 1 p.m. Monday. They've sent questions to the judge, asking to hear some testimony from the trial.
Miles faces four other charges in the December 2015 crash that left Cecil Riner, 33, dead and Riner's wife Jessica seriously injured.
In closing arguments, the state reminded the jury of all the evidence in the case. Blood tests showed Miles had a .139 blood-alcohol content six hours after the crash.
The defense doesn't dispute that Miles was drinking and driving, but said that doesn't mean caused the crash.
"Mr. Miles was under the influence; he was under the influence to the extent that his normal faculties were impaired, but he did not contribute to the cause of this accident," said defense attorney Seth Lavey.
Investigators say Miles rear-ended another car, causing that car to swerve into oncoming traffic and collide with the Riners.
