Miami Twp ,OH :41 -Years old Mitchell Munoz killed after crash with tow truck on Wednesday morning ,August 26th 2015

As Mitchell Muñoz sat in his disabled Audi in the emergency lane of I-75 waiting for a tow truck Wednesday morning, he called his girlfriend and told her he was scared sitting along the busy highway.
His girlfriend, Roxanne Fawcett, of Sidney, said she told Muñoz to stay in his vehicle with his seat belt on.
Moments later, his 2003 Audi was struck by a Ford F-350 in the emergency lane of southbound I-75 near the Ohio 725 exit. Muñoz, 41, was pronounced dead at the scene.
Fawcett said Muñoz was driving from Sidney to Monroe, where he lived and worked, when his car got a flat tire.
Muñoz was originally from Lima, Peru, where he practiced law. He moved to the United States in 2002 with the ultimate goal of becoming a lawyer, Fawcett said. She said his family is traveling to the U.S. from Peru following his death.
Troopers with the Ohio State Highway Patrol said Thomas Leonard, 54, of Franklin, was driving the F-350. Leonard was taken to Kettering Hospital suffering injuries not considered life-threatening.
Speed appears to be a factor in the crash, which remains under investigation. However, charges are pending against Leonard, according to the patrol.
