Raleigh, N.C : Mother's blood-alcohol content 4 times legal limit in fatal crash on Monday afternoon, October 13, 2014
The woman who was driving when her SUV flipped Monday afternoon on Creedmoor Road had a blood-alcohol level four times over the legal limit.
Laura Lynne Smith, 49, of Raleigh, was traveling south on Creedmoor Road when she lost control of the vehicle and hit four trees. Her 12-year-old son, Antony Smith, was pronounced dead at the scene, police said.
According to a wreck report released Tuesday, Laura Smith was traveling 74 mph in a 45 mph zone. Her SUV struck a speed limit sign, three trees and rolled one time before coming to a stop against a fourth tree.
The wreck report further said that Smith's blood-alcohol content was .32, four times more than the state's legal limit.
A 911 caller told the dispatcher that it appeared the child was in the back of the SUV. The wreck report said he was seated on the rear, passenger side of the vehicle.
"They were driving very erratically before they ran off the road. I almost got hit by them," the caller said.
Smith has been charged with misdemeanor death by motor vehicle and exceeding a safe speed. She is in serious condition Tuesday at WakeMed. Additional charges are pending.
Antony Smith was a seventh grader at Ligon Middle School. Grief counselors were on hand at the school on Tuesday.
"In homeroom a whole bunch of people were talking about someone who died and my homeroom teacher was crying," classmate Iesha Lynch said. "My teacher had a moment of silence for him because like, it was just really sad."
The Smith's neighbor, Gordon Oakes, said, "It's quite sad. You never know, from day to day. So I hate to hear it and I'm sorry."
