Everett,WA : Jury convicts man of vehicular assault in motorcycle crash on October, Thursday 26th 2017

A Snohomish County jury on Thursday convicted a man of vehicular assault for a 2014 motorcycle crash that severed his leg and injured his passenger.

Dylan Downey faces up to 5 1/2 years in prison when he’s sentenced in December. Downey has 16 other adult felony convictions, dating back to 2003.

The crash happened July 1, 2014, in Everett. Prosecutors alleged Downey, 34, was riding a stolen motorcycle when he passed a police car. He looked back, likely trying to see if the officer was following.

He lost control of the motorcycle, and it veered off the road and struck a curb. Downey and his passenger were thrown from the bike as it tumbled through the air.

The front end of the motorcycle was torn from the frame, and the riders landed near a utility box. By the time Downey landed his left leg had been amputated. The passenger’s tibiae were broken.

Detectives estimated Downey’s speed at between 49 mph and 73 mph, according to court documents.

Jurors acquitted Downey of possession of a stolen vehicle. They weren’t unanimous that Downey was guilty of vehicular assault under the theory that he was reckless. Instead, they found that he had disregarded the safety of others.
