Waco,TX : Waco man indicted in fatal crash on August, Wednesday 2nd 2017

A McLennan County grand jury indicted a Waco man Wednesday in the May 15 traffic death of his 16-year-son and for injuries sustained by two passengers.

Marcus Marquon Clear, 39, was indicted on charges of intoxication manslaughter and two counts of intoxication assault.

Waco police said at the time that alcohol and excessive speed played roles in the crash, which claimed the life of Latrell Ballard, 16, of Tennessee.

Police investigators say Clear, Ballard’s father, was driving a 2000 GMC Yukon south on North 18th Street shortly before 11 p.m. when he lost control and slammed into a utility pole, flipping the Yukon, Waco police Sgt. Patrick Swanton said in May.

The collision with the pole knocked down live power lines, which caused additional injuries to those in the vehicle, Swanton said.

Ballard died at a local hospital. A front-seat passenger, 31-year-old Durel Nickles, suffered “significant injuries,” Swanton said, as did Janiyah Fowler-Goonan, a 7-year-old girl who was riding in the back seat. The girl suffered burns from the electrical wires and was transferred to a hospital in Temple.
