SPARTANBURG, SC : 11-year-old killed in DUI crash wears pink during suspect court hearing on Friday, 15th February 2019

The family of Ethan Rubenzer, the 11-year-old killed in a DUI crash, wore pink during the suspect's court hearing on Friday- the day Ethan would have turned 12.Ethan died Sunday in the hospital.
The crash happened around 7:15 a.m. last Friday.
Investigators said the crash involved three vehicles on Highway 9 near Bird's Eye View in Boiling Springs.
Troopers said Michael Kelley was charged Friday with felony DUI with great bodily injury, one count of felony DUI involving death and driving with a suspended license.
There was a hearing Friday to revoke a bond for drug charges that he faced prior to the crash. The judge did not make a decision on Kelley's bond after the hearing and will issue a written decision. Kelley will remain in jail until that decision is made.
Kelley's attorney said that the case is still too premature to determine if Kelley was impaired at the time of the crash. He said the only thing that showed impairment was that officers smelled marijuana- but found no paraphernalia.
Spartanburg County Sheriff Chuck Wright called it a "weak argument".
