DELTONA, FL : 4-year-old boy injured in Tuesday Deltona crash on June 3, 2014.
A jury found a Volusia County man not guilty in a hit-and-run crash that injured a 4-year-old boy in Deltona.
Luis Ortiz was badly injured a year and a half ago when he was hit by a car while waiting for the bus.
Jeremy Vega was accused of fleeing the scene of the crash at East Normandy and East Hancock drives.
Investigators said a case of road rage triggered the crash, but the defense spent Tuesday trying to prove their client was never behind the wheel.
There were questions for the witnesses who picked Vega out of a line up but described someone who didn't quite fit the description in statements beforehand.
Luis' father, Abraham Ortiz, described seeing a road rage incident just before and a person that looked like Vega.
"I see a guy come out of the sunroof. He threw something, stuck his middle finger or something up and then sat back down," said Ortiz.
The car then lost control and slammed into the bus stop, authorities said.
"I looked for my son and I found him on the floor. I picked him up, and he's screaming. I was screaming and then it was just crazy," said Ortiz.
Vega was arrested days later when investigators found his mother's Chrysler 300 burning at a Deltona church.
The defense motioned for an acquittal because Vega attorneys claimed no witnesses were able to positively identify Vega as the driver.
