Florence , AL : 29 - years old Johnathon Heath killed and driver charged in Crash after veered off of Alabama 20 and into a creek below on Friday morning , March 6th 2015

A man has been charged with manslaughter in a crash into a frigid creek that killed a passenger in his car.

Florence Police said in a statement Wednesday that 39-year-old Jeremy Dean Martin has been charged in the Friday morning crash that killed 29-year-old Johnathon Heath Atkisson.

Police have said Atkisson's body was found in the car he and Dean had been riding in after it veered off of Alabama 20 and into a creek below. Dean was able to escape the car and get help.

Police say Dean was under the influence at the time of the crash and autopsy results on Atkisson are pending.

It's unclear if Dean has an attorney.
