Itasca County, MN : Hearing continued for man charged in fatal crash on Tuesday October 27 2015
A court hearing for the Deer River man charged with two counts of felony criminal vehicular homicide has been continued to allow attorneys to complete discovery in the matter.
Derrick Lee Cloud, 29, made an appearance Monday morning before Itasca County District Court Judge Korey Wahwassuck Monday morning. At the appearance, Cloud’s hearing was continued to 9 a.m. on Monday, Nov. 30.
The charges against Cloud stem from a two-vehicle crash that occurred on Highway 46 near County Road 143 around 6:41 a.m., on Sept. 8 near Ball Club Lake.
The criminal complaint said that officers responded to the crash and discovered that two people were dead at the scene from injuries they sustained in the crash.
According to the Minnesota State Patrol, Cory Jones, 27, of Cass Lake was driving a 1994 Chevrolet Camaro southbound on Highway 46 when he pulled over and initiated a U-turn. The Camaro was struck broadside on the driver’s side by a southbound 2004 Chevrolet Trailblazer driven by Cloud.
The patrol report stated that Jones and his passenger, Jaclyn Howard, 21, of Deer River were killed. Neither were wearing seatbelts and the Camaro’s airbags did deploy. Cloud was transported to the hospital in Deer River with non-life-threatening injuries. The report also stated that alcohol was detected in Cloud’s system.
According to the criminal complaint, a deputy meet with Cloud who admitted he was the driver of the Trailblazer and that he had drank too much. Cloud was transported to the Deer River hospital where he submitted to a breath test a little more than an hour after the crash. The test revealed an alcohol concentration of .153, nearly twice the legal limit.
After Cloud was discharged from the hospital, he was taken into custody and transported to the Itasca County Jail, the complaint stated. There he told investigators he had been up all night and fell asleep at the time of the crash. He also said he had been drinking alcohol during late evening and early morning at both his residence and the casino in Deer River with the crash victims. They had left Cloud’s residence and were driving to the casino to meet his girlfriend.
The complaint stated that Cloud has a prior conviction for gross misdemeanor refusing to submit to a chemical test in 2006, misdemeanor fifth degree assault in 2010 and misdemeanor domestic assault in 2012.
Cloud has violated his probation on multiple occasions, the complaint said. His driver’s license is suspended for failure to pay child support and failure to appear in court. A domestic abuse order for protection was issued in September 2014 which ordered Cloud not to ship, transport, possess or receive any firearm or ammunition.
The complaint stated that a high-capacity rifle magazine containing multiple rounds of ammunition was found on the front passenger’s seat of the Trailblazer after the crash. A search warrant was executed at Cloud’s residence after the crash and authorities found three firearms, including a firearm that matched the magazine found in the Trailblazer.
