SALEM, MA : Wenham man charged in fatal pedestrian crash on Friday, 16th March 2018
A Wenham man has been charged with motor vehicle homicide in a crash last year that killed a 66-year-old Beverly woman near Salem Hospital.
Shane Tyack, 26, of 35 Arbor St., pleaded not guilty to charges of negligent vehicular homicide and failing to yield to a pedestrian in a crosswalk.
That pedestrian was Karen McCabe, 66, of Beverly, who worked in the human resources department at Salem Hospital, according to her obituary. She died at Boston Medical Center two days after the crash.
McCabe was crossing Proctor Street around 5 p.m. on the evening of Jan. 12, 2017, when she was struck by a GMC Sierra pickup truck registered to Martins Construction, Tyack's employer, according to a police report.
Tyack, who called 911 and remained at the scene, told police he had stopped at the end of Proctor Street, looked both ways, and then pulled forward, not seeing McCabe, who was in front of his truck.
But a driver in an SUV behind him said he could see the woman through both his windshield and the front and rear windows on the pickup truck in front of him.
Dashcam video from a nearby MBTA bus also led investigators to conclude that Tyack should have been able to see the woman. After seeing the accident reconstruction report done by state police, prosecutors and Salem police opted to charge Tyack.
Tyack appeared in Salem District Court for arraignment Friday in response to a summons. He pleaded not guilty to the charges and remains free on personal recognizance while the case is pending.
He is due back in court on April 26.
