NASHUA, NH : Attorneys appeal conviction of mom who killed 3-year-old on Friday, December 30th 2016
An attorney for a New Hampshire mother found guilty of killing her 3-year-old daughter is appealing the verdict.
Katlyn Marin was sentenced to 45 years to life in state prison for the second degree murder of her daughter, Brielle Gage, in 2014.
The Nashua Telegraph reports Attorney Justin Shepherd is questioning whether police seized evidence beyond the scope of their search warrants and whether Marin voluntarily and knowingly waived her Miranda rights. The appeal document also questions whether Marin’s attorneys should have been allowed to cross examine the prosecution’s key witness, Marin’s former boyfriend Michael Rivera.
Gage’s death is one of several high profile child deaths in New Hampshire in recent years. The deaths have shined a spotlight on the state’s Division for Children, Youth and Families.
