Louisville, KY : Woman charged with DUI after 6-year-old on bike seriously injured on April, Tuesday 4th 2017

A 56-year-old woman was charged with driving under the influence after a crash that seriously injured a 6-year-old boy Tuesday night in the Merriwether neighborhood, officials said.

Kimberly Evans, of Louisville, was determined by Louisville Metro Police to not be at fault after hitting the boy at 7 p.m. near East Burnett Avenue and South Hancock Street, according to Louisville Metro Police spokesman Lamont Washington.

However, she was arrested during the investigation following the crash, which Washington said determined she was driving under the influence.

Louisville Metro Police spokeswoman Alicia Smiley said Tuesday that a group of kids were riding their bikes across the intersection when the 6-year-old boy was struck by Evans 1999 Toyota Camry. He was transported to Norton Children's Hospital with serious injuries. Nobody else was hurt.

Washington said Wednesday morning that the child was riding his bicycle down a hill when he rode out in front of Evans' vehicle. There were no updates available Wednesday morning on the boy's condition.

Following the crash, Evans remained at the scene and "showed several clues of impairment on the standardized field sobriety test," according to an arrest citation. She told police that she had "two drinks" earlier in the night.

Evans recorded a blood alcohol content of 0.077, just below the legal limit to operate a motor vehicle in Kentucky of 0.08. Two blood draws were later conducted at Louisville Metro Department of Corrections, the citation said.

She was arrested just before 9 p.m. and charged with one count of driving under the influence. Despite being below the legal limit, Washington said Louisville Metro Police can charge a person with driving under the influence if they "display signs of impairment."

Evans was booked into Metro Corrections at about 11:30 p.m. Tuesday. She was arraigned Wednesday morning in Jefferson District Court and released from Metro Corrections on her own recognizance.
