Essexville, MI : Bay City attorney was involved in a car-pedestrian accident in Hampton Township on Tuesday June 16, 2015

A prominent Bay City attorney was involved in a car-pedestrian accident in Hampton Township, leaving a 52-year-old man in critical condition.

At 10:24 p.m. on Tuesday, June 16, police responded to a crash at the intersection of Center Avenue and North Scheurman Road in Hampton Township. Bay City attorney Edward M. Czuprynski was driving a 2003 Buick LeSabre east on Center and collided with 52-year-old James S. Stivenson, Hampton Township Police Chief Gerald Runde said. Stivenson was crossing Center, police said.

Stivenson was airlifted to Hurley Medical Center in Flint for treatment of critical injuries, Runde said.

At officers' request, a drug recognition expert from the Michigan State Police Tri-City Post responded to the scene and conducted an evaluation of Czuprynski, said MSP Special 1st Lt. David Kaiser. Czuprynski submitted to a preliminary Breathalyzer test, indicating his blood alcohol content was zero, Runde said.

Police took Czuprynski to McLaren Bay Region hospital in Bay City, where Czuprynski was served a warrant for his blood to be drawn, Runde said.

"Anybody involved in a serious accident who gives any indication they may be under the influence of anything is given some tests," Runde said.Officers impounded the Buick, but did not arrest Czuprynski.

After his blood was taken, an officer drove Czuprynski home, Runde said.

"I blew a zero on the breath test, I was going the speed limit, and I had the right of way," Czuprynski told a Times reporter. "I had no clue what happened until I got out of the car and saw the body in the street. I was the first one to call 911; I called within probably 45 seconds after it happened."

Czuprynski said both men were in the wrong place at the wrong time.

The case remains under investigation. Runde said it likely will take a few months before toxicology tests are completed.
