A Faribault woman was struck and killed by a vehicle after allegedly walking onto Interstate 35 near Burnsville early Thursday morning, according to the Minnesota State Patrol.
According to the MSP report, Laura Lucille Lavine, 60, of Faribault, stepped into the right northbound lane of I-35, near the Hwy. 13 overpass, at about 2:44 a.m. The driver, a 40-year-old woman from Burnsville, attempted to avoid Lavine, said the patrol, but was unable.
The state patrol report indicated that the driver had been drinking, but her blood alcohol level was found within the legal limit to drive, according to State Patrol Lt. Tiffani Nielson. A toxicology report is being performed on Lavine to verify whether or not she had been drinking.
Nielson said law enforcement, meanwhile, is investigating the case.
“We are doing a crash reconstruction, which will help re-determine vehicle speeds,” she said. “That typically takes about six months. Because there was a death on the roadway, we will send the report to a prosecutor to review for potential charges.”
Nielson referred to the situation as “unusual.” She said the area does not typically have pedestrian traffic.
She also noted that Lavine was wearing a hooded sweatshirt. The driver reportedly told officers that Lavine was not facing the direction of the car before she stepped onto the road.
Nielson said the driver was cooperative, but when law enforcement arrived on scene, she was “so shaken up she could not get out of the vehicle.”
Officers on scene identified Lavine through her driver’s license, which also confirmed her address in Faribault. Nielson said the family was notified of the death Thursday.
The Burnsville Police Department and Burnsville Fire Department assisted the state patrol on the scene. The northbound lanes of 35W were closed until about 6 a.m. Thursday.
