Police say a 76-year-old man has died after being hit by a vehicle while crossing a street in his upstate New York hometown.

Police in in Oneonta tell The Daily Star of Oneonta that Daniel Heath was crossing a street in the Otsego County city around 10:20 a.m. Wednesday when he was hit by a passing car.

Officers say Heath fell and hit his head. He was taken to Bassett Medical Center in Cooperstown, where he later died.

Police say the 34-year-old driver from Maryland told officers he didn't see the pedestrian until the last minute because of rain and other traffic.

Police ticketed the driver for not yielding the right of way to a pedestrian.
