DOVER, DE : Dover man charged with OWI following Kansasville-area crash on Thursday, 29th March 2018
A Kansasville man is facing charges after allegedly getting drunk and injuring a person in a crash.
Dustin N. Willms, 43, of the 3400 block of Harrison Street, in the Eagle Lake Manor neighborhood, is charged with operating while intoxicated causing injury, second and subsequent offense, a felony.
If convicted, Willms faces a maximum sentence of a $10,000 fine and/or imprisonment of up to six years.
According to the criminal complaint:
At about 7:53 p.m. Wednesday, a Sheriff’s County deputy was dispatched to the intersection of Durand Avenue (Highway 11) and Eagle Road for a crash. The deputy observed a 2001 Oldsmobile and a 2002 Chevy Avalanche, both with heavy front end damage. The Chevy’s front driver side tire was missing.
The Chevy’s operator, Willms, told the deputy he was not injured and did not need attention form rescue personnel. The Oldsmobile’s driver was reportedly injured in the crash and was transported to Ascension All Saints Hospital in Racine for treatment.
Willms told the deputy that he was waiting to make a left turn onto Durand Avenue to go east. Willms said a few vehicles passed him and he drove out into the intersection and never saw the Oldsmobile already traveling on Durand Avenue before crashing with it.
The deputy noticed the odor of intoxicants coming from Willms and asked him if he had consumed any alcohol beverages. Willms reportedly said he had a couple beers and knew he was over the legal limit to drive.
Willms then asked to be transported to the hospital, but was given a field sobriety tests while depuities waited for the ambulance to arrive. Willms reportedly failed each of the tests. A preliminary breath test returned a result of 0.117. Willms was placed under arrest and transported to the Ascension All Saints emergency room.
During Willms’ initial appearance, a cash bond of $1,000 was set. Willms remained in custody as of Thursday afternoon, online records show.
