Authorities say one man is dead and another has minor injuries after they were hit by a vehicle when their truck ran out of gas on a western New York road.

The Monroe County Sheriff's Office says the men were standing along the road after their vehicle ran out of gas around midnight Thursday in the town of Mendon, 10 miles south of Rochester.

Deputies say the men were trying to flag down passing drivers for help when they were hit by a vehicle.

Both men were taken to a hospital, where one died and the other was treated for minor injuries. Their names haven't been released.

Investigators say the driver of the vehicle that hit them will most likely not face charges.
