Moberly,MO : Charges will be refiled in Ashbaker fatal crash on October, Sunday 15th 2017
Charges against a Moberly man accused of involuntary manslaughter and child endangerment following a fatal crash in June in Randolph County have been dropped, but the prosecuting attorney says he will refile.
The Missouri State Highway Patrol reported 27-year-old Nicole Ashbaker of Moberly was killed on June 10, when the Chevrolet Suburban she was driving on State Route C near Huntsville traveled off the roadway and overturned. Four children in the vehicle were also injured.
Following the crash, Danny Bowen, 36, of Moberly, who also sustained serious injuries in the crash, was charged with involuntary manslaughter and four counts of child endangerment.
According to court documents, one of the children told investigators Bowen and Ashbaker were arguing when the crash occurred.
Another child said Bowen was hitting Ashbaker and tried to grab the steering wheel, causing the crash.
Bowen told investigators he was on his cellphone and Ashbaker swerved to avoid a rabbit, court documents state.
Randolph County Prosecuting Attorney Mike Fusselman said he dropped the charges against Bowen because he was still waiting on reports from the highway patrol.
He said when young children testify in cases such as this, legal standards are different.
