Charlotte, NC : Driver killed when leaving car after I-485 crash on Monday morning, Nov 2, 2015

The driver of a SUV that fatally struck a man on Interstate 485 Monday morning is facing charges.

The accident happened around 7:30 a.m. on I-485 outer loop near Interstate 77. Highway Patrol says the man hit a median on the interstate and got out of his pick-up truck to call for assistance. That's when he was fatally struck.

Troopers say they got a call from the man at 7:02 a.m. saying his tire blew out. The man also called his fiance to pick him up from the accident.

Less than a half hour later, Troopers got another call saying a person was struck at the same location. When they arrived on scene they found the man dead. Troopers say a female driver hydroplaned before hitting and killing the man.

The driver of the SUV is facing charges of misdemeanor death by vehicle and exceeding safe speed.

Trooper John Burgin says it is sometimes safer to say in your vehicle after an accident unless there is a safe place nearby.

"In this particular case he would have been safer in the car but it's just unfortunate that he was outside," said Burgin. "With this wide area I thought he did the right thing by getting out of harm's way but he ended up getting in harm's way."

Burgin says the shoulder at that point on I-485 outer loop is very wide.

Investigators are still treating this as an active investigation and are trying to confirm how the 2nd driver went off the road initially.

Burgin says it's been a bad day for accidents across the Charlotte area because of the wet weather conditions.

"Today we've been slammed," said Burgin. "We've had wreck after wreck after wreck and it comes from people not slowing down and hydroplaning because they're going too fast for these roads."

The man's identity has not been released.
