Desiree McCloud was a 27-year-old behavioral neuroscientist, aspiring to become a brain researcher at the Allen Institute, when she was catapulted from her bicycle last year and suffered fatal head injuries.
On Wednesday, the first anniversary of her death, her brother, Cody McCloud, filed claims against Sound Transit and Seattle city government, saying First Hill Streetcar tracks in the Yesler Terrace area caught one of her bike tires and ultimately caused her death.
"This past year has been a literal hell for my family and myself," Cody McCloud said.
McCloud was riding with friends to Alki Beach May 13, 2016 when her bicycle became caught in a groove in the streetcar track on East Yesler Way near 13th Avenue, slowing the bike and launching her over her handlebars. Her helmet was damaged in the crash and she died 11 days later.
Attorneys Phil Arnold and Jeffery Campiche say that the city and Sound Transit could have taken any number of precautions to prevent the tragedy, from building a dedicated cycle track like the nearby one on Broadway to installing rubber inserts in the streetcar track that would have prevented the bicycle from sinking into the gap. Even adding paint to the bicycle lane or prohibiting cyclists from using Yesler would have helped, they say.
