Richmond, VA : Six people died after van crash on Interstate 95 in Caroline County early Saturday, June 25, 2016
Virginia State Police have identified all six of the people who died early Saturday after the van they were traveling in crashed on Interstate 95 in Caroline County.
Four of the victims — including a mother and her 5-year-old son — are from Mexico, and two are from Guatemala, according to a Virginia State Police news release. All of them were ejected from the van, which was carrying 16 people.
The van’s driver, Wenceslao Cruz–Marquez, 50, of Chicago was charged with felony involuntary manslaughter after the crash that occurred at 12:30 a.m.
Only the front passenger seat and driver’s seat had working seat belts, and the 5-year-old victim was not strapped into a booster seat as required by state law, the news release said. Police have also said driver fatigue was likely a factor in the crash.
State police identified the people who died: Yopihua Tehuintle, 34, of Mexico; Epifanio Texmoxtle, 33, of Mexico; Elvira Montiel, 40, and her son, Josè Montiel, 5, of Mexico; Andres F. Francisco, 36, of Guatemala; and Juan Diego, 37, of Guatemala.
None of the victims were in the country legally, a spokeswoman for U.S. Immigration and Customs Enforcement told The Free Lance–Star on Wednesday evening.
Police said the van was traveling from North Carolina to New Jersey, but have declined to provide any other details about the trip as trooper S.R. Page continues to investigate the wreck.
A preliminary hearing for Cruz–Marquez has been set for Aug. 12 in Caroline General District Court, Caroline Commonwealth’s Attorney John Mahoney said after the suspect’s arraignment Wednesday. He is being held without bond in the Pamunkey Regional Jail in Hanover County.
A judge will determine at the hearing whether there is probable cause for the charges, which include six counts of involuntary manslaughter in a vehicle and reckless driving.
The accident occurred on northbound I–95 when a 1998 Dodge van driven by Cruz–Marquez ran off the left side of the road and overcorrected, causing the vehicle to veer right across two lanes and hit a 2016 Toyota Camry, according to state police. The Toyota spun while the van overturned several times, state police Sgt. Steve Vick said.
Ladysmith Volunteer Fire Co. Chief Stephen Melson, who responded to the wreck, said a Spanish-speaking state trooper translated for the van’s passengers, none of whom appeared to speak English.
Police said Cruz–Marquez and nine passengers were taken to Mary Washington Hospital and Spotsylvania Regional Medical Center with serious injuries.
The driver of the Toyota suffered minor injuries and was taken to a hospital by her family, Melson said.
